8(a) “Section 8” Firms Get a Boost, Able to Qualify Through Past Performance in Joint Ventures

Various provisions were introduced this year by the Small Business Administration (SBA) in order to create more contracting opportunities for small businesses. This includes 8(a) small businesses, which are small disadvantaged businesses owned and controlled at least 51% by socially and economically disadvantaged individuals.

8(a) businesses when they have no relevant experience of their own are now allowed to use past performance ratings from Joint Ventures that they have participated in. Prime contractors are now also required to provide a past performance record for when requesting first-tier small business subcontractors.

Various other provisions have been made to federal law, changing the legal and regulatory framework that outlines which businesses receive government contracts.
