SBE Pool Expanded & DVBE/SBE Program Changes in California

The Leveraging State Procurement for an Inclusive Economic Recovery Act of 2021, more commonly known as California Assembly Bill 1574 has been passed into law and will now require state agencies to make ongoing efforts to expand the pool of small business enterprises (SBEs). 

The bill will also help to improve the use of SBEs that are contracted with the state by identifying SBEs who have done little to no business with the state. The bill will also allow for a wider range of persons authorized to bring a civil action for a fraudulent representation of a Disabled Veteran Business Enterprise (DVBE) or SBE performing a commercially useful function on a public contract.

In addition, AB 1574 will help to streamline work of the California Small Business Advocate and the DVBE Advocate by requiring them to be active and to impact the improvement of small business participation. 

The bill will also make changes to the Target Area Contract Preference Act (TACPA) programs and "expand the definition of 'person with a high risk of unemployment' for purposes of the act to include specified individuals with employment barriers, including among others, displaced homeworkers, low-income individuals, individuals with disabilities, single parents, individuals who are English language learners, and transgender and gender nonconforming individuals."
